Wellody Terms of Service

Translation draft — pending legal review. Not legal advice. The Korean version is authoritative; this English text is a convenience translation. The Korean original is itself a draft before legal review (‘초안 — 법률 검토 전’).
Items marked 〔 〕 are not yet decided.

Article 1 Purpose

These Terms set out the rights, obligations and responsibilities of the company and users for using Wellody, a health log and visit preparation app (the “Service”) provided by 〔Business decision: operator name — BD-30〕 (the “Company”).

Article 2 Nature of the Service — please read this first

  1. Wellody is a tool for logging and looking back on your own condition, meds, lab results and daily life, and for preparing a summary to show your clinician at visits.
  2. Wellody is not a medical device and does not diagnose, treat, prescribe or adjust medication. The calculations, summaries and “Seen together” shown in the app organize what appeared together in the logs you entered; they do not determine causes or your health status. This app is not a medical device, so it can’t determine whether you have a disease. To find that out, you need to see a doctor.
  3. Always talk to a doctor or pharmacist before starting or stopping a med or changing a dose.
  4. If you feel it is an emergency, contact 119 (or the nearest emergency room) right away instead of using the app. Wellody does not detect emergencies or report them on your behalf. When you are going through a very hard time, you can also get help from the suicide prevention line 109 (Korea). 〔Business decision: crisis response policy and wording — BD-10〕
  5. Public data such as drug information, drug interaction alerts (DUR), disease names and weather are shown as provided by the source institutions and are not a safety judgment about you personally.

Article 3 Effect and changes of these Terms

  1. These Terms are posted in the app and at 〔Public address: wellody.app/terms〕 and take effect when the user agrees to them.
  2. The Company may change these Terms within the limits of applicable law. When doing so, it will announce the changes and the reasons in the app from 7 days before they take effect (30 days for changes unfavorable to users).
  3. If you do not agree to the changed Terms, you may stop using the Service and delete your account. You can download your logs before deleting.

Article 4 Sign-up and accounts

  1. Users sign up using a method the Company provides: Kakao, Google, Apple or email. Some features can also be used without signing in, through “Sample tour” or “Save on this device only”.
  2. To sign up, you must agree to these Terms, the Privacy Policy, and the processing of health information (sensitive information). External AI, health app connections and family viewing are separate, optional consents.
  3. 〔Business decision: minimum age to join — draft proposal “14 or older”, adult verification method BD-07〕
  4. An account may be used only by its owner. The user is responsible for keeping their sign-in method and the passphrase and recovery code for “Log lock” safe.
  5. If you turn on Log lock and lose both the passphrase and the recovery code, not even the Company can recover the locked logs. The Company does not keep a spare key.
  6. Users can delete their account in the app at any time (Article 10).

Article 5 User obligations

Users must not:

  1. Secretly use another person’s account or information, or log or share another person’s health information without their consent
  2. Guess share links or verification codes, or access or overload the Service or its servers by abnormal means
  3. Use external AI features beyond the Service’s purpose (mass automated requests, attempts to bypass rules, etc.)
  4. Upload content that violates laws or public order

During the testing phase, the Company may ask users to enter only synthetic (fictional) data instead of real health information, and users will follow this guidance. 〔Business decision: when real data is allowed — BD-29〕

Article 6 About AI features

  1. Wellody’s helper “Lody” first answers by searching your logs with on-device rules. If you turn on external AI, polishing Lody’s answers, reading photos of pill bags and prescriptions, reading lab result sheets and organizing spoken logs are processed by an AI model from Anthropic (USA) (what is sent is described in Article 4 of the Privacy Policy). If the external AI consent text changes, consent is asked again before the next use.
  2. Results made by AI (med names and lab values read from photos, logs organized from speech, helper answers) are drafts. Because they may be wrong or incomplete, they are saved as logs only after the user confirms them on the review screen.
  3. AI does not diagnose, prescribe or adjust medication; it does not answer such questions and instead suggests consulting a clinician.
  4. External AI has daily and monthly usage limits; once a limit is reached, only on-device rule-based answers may appear.
  5. The Company does not provide users’ logs for AI training.

Article 7 Sharing features

  1. Users can send a visit summary as a link, PDF or image or show it on screen, and (experimental feature) show it to family within a scope they choose.
  2. You decide what to send and to whom. Anyone who receives the link and verification code can view that summary without signing in, so please check the recipient before sending.
  3. A link stops opening after the set period (up to 30 days) or when withdrawn. However, the Company cannot recall or delete PDFs or images that have already been downloaded or sent elsewhere.
  4. The Company is not responsible for reuse by recipients of information the user sent directly, unless the Company acted intentionally or negligently.

Article 8 Rights to logs and content

  1. The logs, photos, documents and notes users enter belong to the user. The Company processes them only as needed to provide the Service (storage, sync, on-screen display, and summaries and sharing the user requests).
  2. Users can download their logs at any time (CSV, original files, visit summary).
  3. Rights to the app’s design, wording, character (Lody) and software belong to the Company or the lawful rights holders. Public data follows the terms of use of each source.

Article 9 Changes to or suspension of the Service

  1. The Company may change features to improve the Service, or withdraw or change features in the testing phase (marked “demo” or “experimental”).
  2. The Service may pause temporarily because of maintenance, outages or interruptions of external data (public data, weather, etc.). Interruptions known in advance will be announced in the app.
  3. When ending the Service, the Company will give notice from 30 days before and provide a period to download logs before it ends. 〔Business decision: deadline for destruction after termination — BD-05〕

Article 10 Deleting your account (ending the agreement)

  1. Users can delete their account at any time in the app › More › Export or delete my logs. Upon deletion, access is blocked immediately and logs, original files and the sign-in account are destroyed (this cannot be undone). If you cannot use the app, you can request deletion as described on the web guide page (/en/delete-account). 〔Business decision: destruction deadline and backups — BD-05, BD-31〕
  2. If a user seriously violates Article 5, the Company may restrict use after giving prior notice of the reason and an opportunity to explain. Even in this case, the user can download their logs (except where impossible under law).

Article 11 Paid services

〔Business decision: content, price, payment method, auto-renewal, withdrawal of subscription and refunds for paid plans — BD-02, BD-09. Payments are not currently offered; when introduced, this Article and the notices required by the Act on Consumer Protection in Electronic Commerce (「전자상거래 등에서의 소비자보호에 관한 법률」) will be added.〕

Article 12 Limitation of liability

  1. The Company strives to provide the Service reliably, but to the extent permitted by law it is not responsible for the following. Damages caused by the Company’s intent or gross negligence are excepted.
Health decisions made by relying only on the Service’s logs, summaries, AI drafts or public data, without consulting a clinician
Natural disasters, communication failures, and errors or interruptions of data from external institutions (public data, health apps, sign-in providers, etc.)
Damage caused by the user losing, or telling others, their passphrase, recovery code or sign-in method
Later use of information the user shared or downloaded themselves
  2. This Article does not limit user rights set by consumer protection laws such as the Act on the Regulation of Terms and Conditions (「약관의 규제에 관한 법률」).

Article 13 Dispute resolution and jurisdiction

  1. The Company and users will consult in good faith to resolve disputes amicably. Please let us know first through “Contact / report a problem” in the app.
  2. These Terms are governed by the laws of the Republic of Korea.
  3. If litigation is needed, the competent court follows the Civil Procedure Act (「민사소송법」). 〔Business decision: whether to designate a competent court — avoiding exclusive jurisdiction unfavorable to consumers〕
